Foreign Spouse Category - Fresh OCI

Under this category - Foreign National, who is a spouse of (citizen of India OR Indian Origin person) is eligible for OCI.
DOCUMENTS REQUIRED:

  1. Duly filled Application form
    Login to http://ociservices.gov.in Applicants need to upload all the requisite documents and photo and signature
  2. 2’*2’ white background photos – 2
  3. Proof of citizenship:
  4. Applicant passport copy and birth certificate (all Sri Lankan documents in Tamil or Sinhala needs English Translation) and has to be attested by Ministry of Foreign Affairs, Foreign Employment & tourism Sri Lanka (MOFA). Passport should be valid for at least 6 months from the date of application and in case of foreign passport (country other than Sri Lanka) residence visa should be valid for 6 months at least.
  5. Cancelled/surrendered Indian Passport person (In case applicant has surrendered Indian passport in or after 2010, they need to submit surrender certificate as well)
  6. Proof of Address mentioned Application
    Copy of Electricity bill or NIC card or Telephone bill or water bill in the name of own/spouse/parents/grandparents
    Or
    In case of rented accommodation, Lease/Rent agreement from tenants and No Objection letter from Tenant along with copy of electricity bill/NIC card/Telephone bill/Water Bill mentioning the address of application.
  7. Marriage Certificate
    1. If marriage has happened in Sri Lanka, then marriage certificate needs to be Ministry of Foreign Affairs, Foreign Employment & tourism Sri Lanka (MOFA) and the same need to be attested with any Indian Mission.
    2. If marriage has happened in foreign country, then the marriage certificate needs to be attested with competent Indian authority

   8   Police Clerance Certificate (Except minors need to submit Police clearance Certificate, and further it needs to be  attested by Ministry of Foreign Affairs, Foreign Employment & tourism Sri Lanka (MOFA).

  1. Proof of Indian Origin of Root person
    Passport copy of spouse with spouse name endorsed in the passport
    Or
    Copy of OCI card of Spouse along with copy of documents on which the OCI card was granted to the Spouse.
    Or
    Proof of Indian of spouse side, like:
    Copy of Indian Passport of root person
    Or
    Digital copy of inherited land/ Immoveable property documents in India
    Or
    Copy of Inherited Land documents attested from competent Indian authorities
    Or
    Copy of original patta/ Immoveable property documents

               Or

              Certificate of Registration issued by Sri Lankan Government

  • The Citizenship Act, No 18 of 1948

        or

  • The India and Pakistan Residence (Citizenship) Act No 3 of 1949

or

  • The Indo Ceylon Agreement (Implementation) Act No 14 of 1967

or

  • The grant of Citizenship to the Stateless Persons Act no 5 of 1986

or

  • The grant of Citizenship to Stateless Person (Special Provisions) Act no 39 of 1988
  • The grant of Citizenship to Persons if Indian Origin  (Amendment)   Act No 35 of 2003

                    The above documents will be accepted with Citizenship Confirmation obtained from Department for the Registration of persons of Indian Origin (Premises of Department of Immigration and Emigration), Battaramulla and it needs to be attested by Ministry of Foreign Affairs, Foreign Employment & tourism Sri Lanka (MOFA).      

                                      Or

                 India- Sri Lanka Passport/ India- Ceylon Passport

                              Or

             The Registration records maintained at High Commission of India   Colombo and Assistant High Commission of India, Kandy

Note:

             Duly filled application along with photocopies of supporting documents need to submitted in the High Commission of India any working day while after booking appointment from the official website. (www.hcicolombocpv.in )

Persons registered as OCI Beneficiaries have not been given any voting rights, election to Lok Sabha/Rajya Sabha/Legislative Assembly/Council, holding Constitutional posts such as President, Vice President, Judge of Supreme Court/High Court.
• Any further benefits to OCIs will be notified by the Ministry of Overseas Indian Affairs (MOIA) under section 7B (1) of the Citizenship Act, 1955.
• If it is found that the registration as an OCI Beneficiaries was obtained by means of fraud, false representation or concealment of any material fact or the registered OCI has shown disaffection towards the Constitution of India or comes under any of the provisions of section 7D of the Citizenship Act, the registration of such person will not only be cancelled forthwith but he/she will also be blacklisted from visiting India.
